Supreme Court Stops Registration Of BS4 Vehicles Until Further Notice

The Supreme Court has ruled that registration of BS4 compliant vehicles will not be allowed until further notice. The new ruling comes after the Court announced its annoyance at the number of vehicles that were sold during the lockdown that was called for in light of the Covid-19 pandemic. A hearing has been scheduled for 13 August.

The earlier deadline for BS4 vehicles was 31 March this year, and the court had announced in its order dated 27 March that manufacturers were allowed to sell BS4 compliant vehicles for a period of 10 days after the lockdown was lifted.

The ruling allowed for 10 percent of unsold BS4 vehicles to be sold during the 10 day period, and also stated that vehicles could not be sold in the Delhi-NCR regions.

The Court also said that BS4 vehicles that were sold but not registered because of the lockdown could be registered after the lockdown was lifted. July saw the Supreme Court withdraw its order dated 27 March after it noted that a total 2.25 lakh vehicles were sold and unregistered as compared to the 1.05 lakh two-wheelers, 2,250 passenger vehicles and 2,000 commercial vehicles that the court allowed for.

The Federation of Automobile Dealers Association has approached the Supreme Court for a second during March requesting for an extension up to 31 May for BS4 vehicle registrations.

The Association said that Covid-19 outbreak had resulted in a 70 percent drop in sales, and the extension would help. The Apex Court had rejected the plea for the extension.

The Court had earlier passed a judgement stating that all BS4 vehicles registered after the deadline would be considered invalid, however registration for vehicles that were uploaded to the Government's VAHAN portal would hold good.

This isn't good news for people who have purchased vehicles during this period. While the Court is right in its judgement and must punish manufacturers and dealers who violated its orders, it must also keep in mind the effect that a ruling has on end users.
