Skoda Rapid Monte Carlo Edition Sales To Be Stopped — Find Out Why

The additional district judge Mukesh Kumar said that the case is as "crystal clear" and that the automotive company had infringed the clothing company's trademark by launching their product under Monte Carlo moniker.

The court observed while passing a temporary injunction saying that "the plaintiff has a prima facie case on merit and balance of convenience also lies in its favour. The plaintiff would suffer irreparable loss if an injunction is not granted."

As a result of the court order, Skoda India, and all its sales channels have been restrained from using "Monte Carlo" mark from "advertising, manufacturing, selling and/or offering for sale, or permitting others to sell or offer for sale, directly or indirectly or dealing in any goods or services".

Additionally, Skoda has been refrained from using any other trademark that may be "identical or deceptively similar" to the clothing trademark in any way to cause an infringement of the clothing company's brand, till further order.

The Skoda Rapid Monte Carlo is available in petrol and diesel variants in India. The petrol model of the Skoda Rapid Monte Carlo retails in the range of Rs 10.75 to 11.75 lakh (Ex-showroom), while the diesel variant retails in the range of Rs 12.46 to Rs 13.57 lakh.

Skoda's Monte Carlo name is inspired by the carmaker's motorsports history. Vehicles with Monte Carlo edition receive two select dual-colour options: Flash Red with black roof and candy White with black roof.

While the dimensions of the Rapid Monte Carlo Edition is similar to the regular model, the exclusive edition model distinguishes itself with a sporty image.

There is no official announcement from Skoda Auto India, for now, the carmaker cannot sell any car with the "Monte Carlo" name in any of its vehicles till the issue resolved legally. That said, Skoda might re-badge the edition and sell them in India.
