CCI Investigates JCB For Monopoly
The Competition Commission of India (CCI), has raided the offices of JCB, the UK based construction equipment maker. The raid was conducted in connection with a case of JCB being in a dominant position to keep the competitors from the market.
A CCI official said that JCB did not cooperate when questioned so CCI had no other option but to raid them. The documents and data collected will be verified thoroughly before taking the next step in the investigation.
As per the current Act, the Director General (DG) can conduct raids like this after obtaining a warrant from the metropolitan magistrate. This is the first instance where CCI has raided the compound of a company.
The investigation started after a Coimbatore based construction equipment maker named Bull Machines filed a complaint against JCB stating that JCB was restraining dealers from dealing with construction machines called backhoe loaders.
A statement from JCB said that the company is very confident that the CCI will drop the allegations after investigation because the complaint is baseless.
The CCI is very strict when it comes to monopoly of automobiles or automobile spares. CCI had earlier fined 14 car manufacturers for monopoly of spares.
