Lajja Shah, a woman driver accused of a road accident walks free after judge spares her jail term because of her gender.

A woman driver who killed a motorcycle pillion has been spared jail term because of her gender and profession. The decision was passed by a magistrate a week ago.

Lajja Shah, a speech therapist, associated with Reliance Foundation Hospital ran into a two-wheeler in 2015, killing the pillion rider. Shah was driving her Toyota Innova, and the incident took place in Girgaum Chowpatty, Mumbai.

The two-wheeler rider, Akash Singh (22) was riding with his sister Jyoti as pillion when the incident took place. Shah rear-ended the two-wheeler in her vehicle on May 25, 2015. Jyothi succumbed to her injuries later.

Shah never spent time in police custody and the magistrate, VR Dasari, passed the verdict saying, "The accused is a woman and a doctor by profession, so I am of the view that instead of sentencing her to imprisonment, a fine may be imposed." She walked free, having to pay a fine of Rs 72,500.

Shah was booked under sections 279 (rash driving), 304A (causing death by negligence), and 337 (causing hurt by act endangering life or personal safety of others). The prosecution was led by CY Patil, who examined seven witnesses to prove Shah's guilt, including Akash.

Shah's advocate even claimed that Akash and Jyoti were to be blamed for the accident since they were riding dangerously in traffic. The magistrate rejected that claim saying "The tyre brake marks of the Innova were present on the spot to the extent of 10 to 15 feet at its backside. This shows that at the time of the incident, the Innova was certainly at high speed."
