Mercedes Unfair Trade Practice Charges Cleared

Unfair trade practice charges against Luxury car maker Mercedes Benz India has finally been cleared by national consumer commission after 12 years of legal fight. Mercedes Benz charges of illegal practice was on phasing out one of its vehicle models.

Mercedes and its Indian partner Tata Engineering and Locomotive Co.(TELCO) in manufacturing of high-end cars here, got the relief as the National Consumer Dispute Redressal Commission dismissed a complaint by Mumbai-based Marine Container Services (India) leveling the charges of unfair trade practice against Mercedes for selling it a model which was phased out around a year after its sale.

The NCDRC dismissed the complaint ruling that selling a particular model to a customer a year before it is phased out and upgraded with a newer version does not amount to unfair trade practice by Mercedes.

"Merc Benz India and TELCO can at best be said to have made a representation to the effect that they had no immediate plans to launch a new model. Launch of a new model after more than a year after the sale of the car cannot by any stretch come within the meaning of the term 'immediate'," an NCDRC bench of Justice R C Jain and member S K Naik said.
