Car Crash Guard To Attract Rs 5000 Fine Amount

In a recent notification by the Indian Government, car crash guard or commonly known as bull bars for SUVs were banned as the macho looking accessory posed safety concerns for both road users as well as occupants of the vehicle.

As per Times of India, the government has asked all states to take strict action against unauthorised use of crash guards or bull bars in cars and SUVs stating that such accessories pose a safety concern for pedestrians.

These car crash guards which are mounted to vehicles is in violation of the Motor Vehicles Act, 1988, which attracts a fine of Rs 1,000 for the driver for the first offence, Rs 2,000 for the second time or subsequent offences, while the punishment for seller or deliverer could be Rs 5,000.

    "It is brought to your notice that the fitments of crash guards/ bull bar is in contravention of section 52 of the Motor Vehicles Act, 1988 and attracts penalty under section 190 and 191 of the Motor Vehicles Act, 1988," the Ministry of Road Transport and Highways has written to the Principal Secretaries, Secretaries and Commissioners, Transport of the states.

    "It is therefore requested that states may take strict action against the unauthorised fitment of crash guard/bull bar on the motor vehicles," it said.

    As per Section 190 of the Motor Vehicles Act, 1988, any person who drives or causes or allows to be driven, in any public place a motor vehicle and which breaks the standards ordered in connection to road safety, control of noise and air-pollution, shall be fined for the first offence of Rs 1,000 and any second or subsequent offence with a fine of Rs 2,000.

    Also, for sellers or importer of these car crash guards, Section 191 prescribes, "Whoever being an importer of or dealer in motor vehicles, sells or delivers or offers to sell or deliver a motor vehicle or trailer in such condition that the use thereof in a public place would be in contravention of Chapter VII or any rule made thereunder or alters the motor vehicle or trailer so as to render its conditions such that its use in a public place would be in contravention of Chapter VII or any rule made thereunder shall be punishable with fine which may extend to Rs 5,000."

    While car bumper crash guard or bull cars for SUVs look stylish and macho, these accessories not only pose safety concerns for the pedestrians but the car and its occupants as well.

    Car manufacturers build or develop vehicles with safety features as their top priority, and if the crash is a requirement, then carmakers would be fitting them on their cars before it goes on sale.
