Supreme Court’s Final Order On FADA’s Plea For BS4 Vehicle Registration

Vinkesh Gulati, President, Federation of Automobile Dealers Association Director has announced that the Supreme Court finally released its order about the fate of BS4 vehicles in Delhi. It has allowed the provision of RC to all those vehicles for which taxes had been paid and registration numbers were generated as well.

Mr Gulati tweeted, "The SC order for BS4 vehicles in Delhi is finally out and all vehicles where taxes were paid and numbers were generated, RC will now be provided. A huge benefit to all customers who waited for so long. FADA continues to relentlessly work for dealers and customers as well!"

On March 27, 2020, the Supreme Court of India stated that BS4 vehicles were allowed for 10 days due to the ongoing Covid-19 pandemic and the resulting nation-wide lockdown. However, the issues started when the Apex court claimed that the dealers sold more than 10 per cent of its stock in the said period.

The court also had asked FADA to provide the data for BS4 vehicle sales, which will be used to evaluate the number of registrations received from the government portal. The apex court had accused FADA of selling over 17,000 vehicles, which were not registered with the VAHAN portal.

Apart from that, the court reported that the number provided for BS4 vehicle sales by the dealer federation does not add up. The governing body warned the federation for taking advantage of the rules, as the number reports that it has sold more vehicles than it had allowed. The limit of sales and registration of BS4 vehicles after the deadline was set at 1.09 lakh.

In its defence, FADA stated that it was seeking permission to register vehicles that were sold before the deadline in the Indian market. According to the reports submitted by FADA, the dealers who are members of the entity have sold 94,000 BS4 vehicles. While non-member dealers have sold over 1.3 lakh BS4 vehicles.

However, now all the confusions and speculation has put to rest due to the recent final judgment passed by the Supreme Court of India. Dealers and customers can now rejoice as the vehicles sold during the said period become legal as long the registration number of the vehicle was generated.
