Scooter Does Not Deliver Claimed Mileage — Court Asks Company To Rectify The Issue
A consumer court has asked TVS Service Centre to repair the scooter to deliver the advertised mileage. If the mileage is not improved, the court has directed TVS to refund the price of the scooter.
Automobile manufacturers must be careful while advertisement the mileage of their vehicle. A consumer court has directed an automaker to repair the vehicle to deliver the promised mileage in the advertisement.
Gunvant Mehta, a senior citizen from Rajkot, purchased a TVS Jupiter in September 2014 from a local dealership. The company sold the scooter with a claimed mileage of 62km/l. But Mehta was not satisfied with the scooter as it never returned the claimed mileage.
The court has also stated that, even after repairing the scooter, if the mileage does not improve, the company should refund the price of the scooter. TVS has been asked to make an initial payment of Rs 10,000 to the customer as compensation.
After initial communication with TVS and showroom, Mehta moved the issue to the Rajkot District Consumer Dispute Redressal Forum. Mehta demanded a full refund and also Rs 54,000 towards petrol costs.
During the hearing of the case, the company produced a report on the mileage. In May 2015, the scooter recorded a mileage of 43km/l. But the mileage improved drastically to 65.51km/l in March 2016.
But Mehta made a strong objection to the company's claimed mileage of 65.51km/l. After hearing both the sides. The court referred to previous six orders passed by consumer courts on similar issues.
In all the previous cases, the court has ordered auto companies to refund the price of the vehicle to the customers. The court instructed Mehta to hand over the scooter to TVS Service Centre for repair works.
