Volkswagen & Dealer Fined INR 3 Lakh By Consumer Forum
Volkswagen India and their Mumbai dealer KSM Motors have been ordered to pay a fine of INR 3 lakh and refund INR 9.12 lakh, which is the cost of the car, for selling a product with manufacturing defect, by a consumer forum in the city.
The Mumbai Districts Consumer's Forum has asked the manufacturer and the dealer to pay the amount to Bharat Kariya of Vashi, Mumbai, who purchased a Vento sedan in 2011. The forum concluded that the company & dealer had resorted to unfair practices.
Kariya had originally intended to buy a diesel Vento, but decided to go for the petrol variant because of a 6 months waiting period for the former. Kariya had opted for a car loan and had made the full payment for the car.
When the Vento was delivered to him, however, he noticed that on several parts of the exterior, the painting was defective. Upon bringing this to the attention of the dealer he was informed that it was due to the car having been parked in the workshop.
Kariya contacted the manufacturer regarding the defective body paint, but did not receive a response. He once again contacted the dealer who acknowledged the problem and repaired the same, thus proving the defect was indeed a manufacturing defect, which was used as proof in the case.
